A Non-Molestation Order is a court order that prevents someone from using or threatening violence, harassing or intimidating you. If the order is breached, it’s a criminal offence and the police can take immediate action.
Yes, legal aid may be available if you’re on a low income and can provide evidence of domestic abuse. A solicitor can assess your eligibility and help you apply. Although Holland Family Law does not offer legal aid, we do keep legal fees to a minimum.
Evidence might include police reports, medical records, witness statements or communications such as texts and emails. Your solicitor will advise you on what’s most relevant.
Yes. You can apply for court orders to protect your children, including Child Arrangements Orders or Prohibited Steps Orders. These can limit contact or restrict specific actions.
Seek advice straight away. Contact a solicitor, the police or a domestic abuse helpline. You may be able to apply for an emergency protective order the same day.
In some urgent cases, you can apply without the other person being notified first (known as a ‘without notice’ application). They’ll be informed later when the court decides how to proceed.
An emergency order can often be granted on the same day. Full hearings may take longer but urgent protection is available quickly if needed.
Breaching a Non-Molestation Order is a criminal offence. The police can arrest the person and take enforcement action.
